DP Ruto lawyers go after ICC staff, witnesses

The Deputy President William Ruto’s lawyers are seeking an independent prosecutor to investigate witnesses and International Criminal Court staff whom they accuse of lying and even having sexual relations with witnesses and their families.

Mr Ruto’s defence team, led by Karim Khan, in a letter to the ICC judges who dropped the crimes against humanity charges case against him and journalist Joshua Sang last month, says there is enough evidence in the trial record to prove perjury charges against prosecution witnesses, intermediaries and possibly ICC staff.

The letter claims that staff in Fatou Bensouda’s office and intermediaries “tampered with or interfered with the collection of evidence by the Office of the Prosecutor (OTP) by identifying and coaching witnesses to give false information which then formed the basis of the case against Mr Ruto.”

Worse still, the DP’s team contends that ICC staff may have engaged in sexual relations with witnesses and their families and a host of other actions contrary to Article 70 of the Rome Statute.

“The Defence submits that the OTP evidence gives reason to believe that ICC staff members may have engaged in sexual relations with witnesses and their families, been bribed by witnesses and were party to the submission of false financial claims and obtained pecuniary benefit from the false financial claims,” read the letter sent to the ICC on Tuesday.
